Seth Lieberman practices in Pryor Cashman’s Bankruptcy Group. Seth concentrates his practice in both bankruptcy litigation and appeals as well as counseling and support of corporate clients in various commercial and business transactions. Seth has recently represented:
- A debtor in a 23-day, nondischargeability patent infringement trial, where almost 90% of the $36 million claim was discharged, reported in Fuji Photo Film Co., Ltd. v. Benun (In re Benun), 386 B.R. 59 (Bankr. D.N.J. 2008)
- Unsecured creditors in the bankruptcy cases of Levitz Furniture, Inc. and Fortunoff Fine Jewelry and Silverware, LLC
- Indenture trustees in the bankruptcy cases of Tropicana Entertainment, LLC and Bayonne Medical Center
- The unsecured creditors’ committee in the denial of certiorari of the Third Circuit’s determination that the reimbursement of certain unemployment benefits was not entitled to priority under the Bankruptcy Code, thus increasing unsecured creditors’ distributions by approximately 18 cents, reported in N.J. Dep’t of Labor v. Reconstituted Comm. of Unsecured Creditors of the United Healthcare Sys., Inc., 546 U.S. 814 (2005)
- A bankruptcy professional in a successful reversal of the bankruptcy court’s refusal to award fees under a contingency fee agreement, reported in Riker, Danzig, Scherer, Hyland & Perretti LLP v. Official Comm. of Unsecured Creditors (In re Smart World Techs., LLC), 383 B.R. 869 (S.D.N.Y. 2008)
Seth is a Certified Mediator for the New York State Unified Court System. While in law school, he served as Editor-in-Chief of the Cardozo Journal of Conflict Resolution, earned a Cardozo Certificate in Dispute Resolution and was an intern for the Chief Executive Officer of the American Arbitration Association. Prior to law school, Seth worked as a Case Manager in the Washington, DC office of JAMS: The Resolution Experts.
