Jeanne Matase has broad transactional real estate experience including acquisition, financing, commercial leasing and closing. She has represented a wide range of developers in the acquisition of real property, negotiation of purchase money and construction financing, closings and development agreements. Her experience also includes:

  • Advocacy on behalf of developers before the New York City Department of Housing Preservation and Development including site eligibility analysis and preparation of applications under Sections 421(a), 421(g), and 11-243 (formerly known as Section J-51) of the New York State Real Property Tax Law
  • Preparation of Condominium Declarations for maximization of tax incentive benefits
  • Preparation of Lower Income Housing Plans pursuant to Section 23-90 of the New York City Zoning Resolution in order to qualify for increased floor area of projects
  • Representation before the N.Y. State Attorney General’s Office, including the preparation of cooperative and condominium offering plans, No Action Letters, De-Facto No Action Letters and No Jurisdiction Letters

Jeanne has also represented numerous cooperative and condominium boards on a wide variety of matters, including:

  • Review and interpretation of governing documents
  • Amendments to declaration of condominium, by-laws and tax maps
  • Conversion and sale of common elements to become part of a unit
  • Claims against  boards
  • Enforcement of unit owner and shareholder obligations
  • Claims against the Sponsor for construction defects
  • Building mortgage refinance (coops)
  • Intra-building agreements, e.g., shoring and roof protection
  • Negotiation and drafting of service agreements and capital improvement contracts
  • Issues between unit owners and the board, e.g., non-payment of common charges, sublets, pet policies
