Tina Moss joined Pryor Cashman in 2002 and has more than 15 years of experience in bankruptcy, corporate restructuring, and related litigation. She has represented various stakeholders, including creditors’ committees, secured and unsecured creditors, commercial landlords, indenture trustees, chapter 7 trustees, and liquidating trustees in all aspects of chapter 11 and chapter 7 proceedings. Tina has litigated numerous bankruptcy and insolvency related issues, such as preferences and fraudulent transfers, director and officer liability, substantive consolidation, equitable subordination, claims disputes, and plan confirmation.

An important focus of Tina’s practice is the representation of major financial institutions in their capacity as indenture trustee or agent in connection with bond and loan facility defaults.  She has represented indenture trustees and agents in numerous complex chapter 11 and chapter 7 cases, including NewPage, Tribune, Lehman, Majestic Star Casinos, Finlay Enterprises, Metaldyne, NTK, Star Tribune, WCI Communities, Tropicana Entertainment, American Home Mortgage, HomeBanc Mortgage, Insight Health Services, Calpine, Asarco, American Business Financial Services, WorldCom, Kaiser Aluminum, Northwestern, Frontier Insurance, Wickes, Trenwick America, Avado Brands, Budget Group, Kmart, and Petroleum Geo-Systems.  

Tina has extensive experience in counseling financial institutions acting as indenture trustees or agents with respect to:

  • Exercising their post-default rights and obligations under debt indentures and loan agreements and under governing federal or state law
  • Participating in the negotiation of issuer reorganizations and restructurings
  • Serving as members of official creditor committees
  • Defending and prosecuting litigation claims
  • Coordinating and facilitating distributions to holders resulting from issuer reorganizations and liquidations
  • Maintaining bondholder communications
