Pryor Cashman Represents Scarsdale Woman's Club In Court Battle Over Easement

As reported in the March 20, 2009 edition of The Scarsdale Inquirer, the Scarsdale Woman’s Club, represented by Pryor Cashman LLP, has instituted a declaratory judgment and trespass action in Westchester County Supreme Court to enforce the Club’s rights in an easement against the owners of adjoining property. Pryor Cashman Litigation Counsel Luisa Hagemeier is representing the Club.    

The easement, conveyed in 1928 together with title to the Club's land, expressly granted the Club the right of “passage and re-passage of all persons and vehicles” over a strip of the adjoining property known as “Rowsley Drive.” In May 2008, the owners of the adjoining property, over which the easement runs, obstructed its use and indicated their intent to continue preventing the Club’s use of Rowsley Drive.
