Partner Joshua Zuckerberg Speaks To Daily News About Male on Male Sexual Harassment at Workplace

Labor and Employment Group Partner Joshua Zuckerberg was interviewed by the New York Daily News for its January 18, 2010 article entitled “Male on male sexual harassment at workplace is on the rise.”

As Zuckerberg told the Daily News: “In tough times, you have more layoffs and more terminations. You see more people being frustrated by these terminations and challenging them. People are trying to find a theory to challenge their termination."

Man-on-man sexual harassment charges, however, are difficult to prove in court. “Just being a jerk in the workplace is not actionable,” he explains. “If I go around and harass men and women alike, it's unlikely that that is actionable. For a man to prove man-on-man sexual harassment in federal court, they must prove it is based on gender.”
