Minimum Wage to Rise to $7.25 an Hour

Legal Update
July 22, 2009

As of July 24, 2009, the federal minimum wage will rise to $7.25 per hour. This rate is higher than New York State’s current minimum wage, which has been $7.15 per hour since January 2007.

When the federal and state minimum wages are different, New York employees are entitled to the higher of the two. As explained on the New York State Department of Labor website, “If the federal minimum wage rises above the state rate, New York’s rate will rise with it.”  In other words, as of July 24, 2009, the New York minimum wage will rise to $7.25 per hour.

New York employers should make sure that their employees’ wages comport with this new rate. Please contact a member of Pryor Cashman’s Labor and Employment Group if you have any questions about this change to the minimum rate.
