Morell Speaks to Law360 About Future of H-1B Program
Following President Trump’s recent criticism of the H-1B lottery system and call for greater scrutiny of the skilled guest worker program, employers and employees who rely on these visas are bracing for reforms that could significantly alter the current framework.
Each year, 85,000 H-1B visas are made available via a randomized lottery, a system Trump has denounced. While some legal experts believe the president will seek to dismantle the lottery and replace it with a structure that prioritizes higher-skilled, higher-paid workers, others insist the lottery will remain in place.
Speaking with Law360, Immigration Partner Avram Morell opined that the government will not move to eradicate the lottery entirely, but will instead interpret the rules on “who is eligible for an H-1B as carefully as possible.”
