Pryor Cashman Wins Motion Establishing Personal Jurisdiction Over Defendant on Basis of Website Activity

Pryor Cashman obtained a significant victory for client Parker Waichman Alonso LLP in a developing area of law concerning the establishment of personal jurisdiction on the basis of a defendant’s Internet activity. 

Pryor Cashman Partners Brad D. Rose and William Charron successfully argued before the U.S. District Court for the Southern District of New York that the defendant in a trademark infringement case, Orlando Firm PC, was susceptible to personal jurisdiction in New York, notwithstanding the defendant’s location in Georgia, because the defendant’s website purposefully availed itself of the New York marketplace.

Critical to the court’s decision was the testimony and admissions of the defendant’s representative elicited by Pryor Cashman during limited discovery on the issue.
