Brendan Everman is a member of Pryor Cashman’s Litigation and Media + Entertainment Groups.

He represents businesses in high-stakes disputes across a wide variety of industries, including media, real estate, entertainment, financial services, and technology. Brendan has significant experience counseling clients on contract disputes, business torts, company and partnership breakups, copyright and trademark infringement, defamation, and non-compete agreements. He has represented clients in state and federal courts across the country, including the U.S. Supreme Court.

Highlights of Brendan’s victories for his clients include:

  • Dismissal of copyright infringement claims relating to Luis Fonsi’s world record-breaking song “Despacito,” Da Baby’s No. 1 song “Rockstar,” and Lil Baby’s No. 1 album My Turn.
  • Summary judgment defeating a claim for $145 million in damages for an alleged breach of a company operating agreement.
  • Defense judgment and an award of prevailing party attorneys’ fees following a bench trial in a real estate dispute where the plaintiff sought $21 million in damages; following trial, the judge remarked that Brendan was an “outstanding lawyer” who “did an exemplary job.”
  • Arbitration award in favor of media company finding that its joint venture has the perpetual right to license “Tom Clancy’s Net Force” in TV, streaming, films, and video games.
  • Summary judgment against Bang Energy for the infringement of hundreds of music copyrights on TikTok and Instagram.

Pro Bono

Brendan is committed to pro bono work. In connection with the University of Miami Immigration Clinic, Brendan represented two individuals included in the “Somali 92” class action lawsuit arising from a botched deportation flight to Somalia in December 2017. The American Immigration Lawyers Association recognized Brendan and the rest of the Somali 92 team with the 2019 Arthur C. Helton Human Rights Award for outstanding service in advancing the cause of human rights.
