Partner Judith Poller Speaks to N.Y. Daily News About Importance of Prenups
Partner Judith L. Poller, Co-Chair of Pryor Cashman's Family Law Group, spoke to the New York Daily News for its October 14, 2013 article “Learn from the Kardashians' Mistakes: Time to Brush up on Prenups.” The article emphasizes the importance of pre-nuptial agreements when preparing for marriage.
Research conducted by the American Academy of Matrimonial Lawyers has shown that between 2005 and 2010, 70% of divorce lawyers say they have seen an increase in pre-nuptial agreements. With more and more marriages occurring later in life, pre-nuptial agreements have become increasingly important for people looking to protect their assets.
As Poller explained to the Daily News, “a prenuptial agreement, if done correctly, is a legally binding contract that provides for the division of marital assets, spousal support in the event of a divorce and how assets will be bequeathed upon the death of a spouse.”
When asked whether a prenup was a bad way to start off a marriage, Poller responded that “having to address and discuss money issues and difficult topics can be useful. Marriage, at times, is full of difficult issues and getting through them and communicating well is important. Most people get through the prenup process with some better communication skills.”
Poller also noted that while New York permits post-nuptial agreements, meaning agreement signed after the parties are married, not every state does.
