Trends in Distributing a Business Interest and Enhanced Earning Capacity

Judith L. Poller, co-chair of Pryor Cashman’s Family Law Group, and associates Elizabeth S. Warner and Joshua H. Pike authored an article for the New York Law Journal entitled “Trends in Distributing a Business Interest and Enhanced Earning Capacity.”

The article explores the complex issue of equitable distribution to a non-titled spouse of a marital asset consisting of a business interest, professional practice (Business Interest) and/or professional degree, license, or celebrity obtained during the marriage (Enhanced Earning Capacity). The issue plagues both judges and practitioners in New York divorce actions partially due to the limited available court decisions on it.
