Pryor Cashman Wins $12.7 Million Arbitration Award For Former CryoGen Shareholders Against American Medical Systems, Inc.

In a unanimous arbitration decision issued December 18, 2007, Pryor Cashman litigation partners Jamie M. Brickell and Lisa M. Buckley obtained a $12.7 million award, including more than $1 million in legal fees and costs, against American Medical Systems, Inc. (AMS).
The dispute arose out of AMS’ acquisition of CryoGen, Inc. (CryoGen) pursuant to an agreement requiring AMS to utilize “commercially reasonable” efforts in exploiting CryoGen’s “Her Option” product during a three-year earn out period.
