Partner Joshua Zuckerberg Quoted in Article About NFL/NFLPA Collusion Case

Pryor Cashman Labor Partner Joshua Zuckerberg was quoted in Street & Smith’s Sports Business Daily on February 25, 2008 in an article entitled “NFLPA Collusion Case: First Salvo?”

As noted in the article by Liz Mullen & Daniel Kaplan, the NFLPA, in a proceeding initiated by it before NFL Special Master Stephen Burbank last week, is alleging that the NFL violated the anti-collusion and anticircumvention provisions of the CBA when it voted in October to lower the debt ceiling for NFL clubs and the league overall.

Zuckerberg, a former National Labor Relations Board attorney for the Manhattan office, told Street & Smith’s that if an entity, be it a league or a steelmaker, can prove an action is core to its entrepreneurial mission, then the action is exempt under labor law. “I doubt there is something in their CBA about debt. It will be asking the arbitrator to make a leap of faith.” Zuckerberg noted that if the action does have a labor effect, an arbitrator might then agree the two sides should bargain over the impact of such a move.
