Kate Garber is a member of Pryor Cashman’s Intellectual Property Group, where her practice is focused on trademark and copyright law.

She regularly represents clients in trademark litigation in federal court and before the Trademark Trial and Appeal Board (TTAB), as well as in copyright litigation in federal court and before the Copyright Royalty Board (CRB), and advises clients on a variety of trademark matters.

Litigation Matter Highlights

  • Artist Brooke Comegys, whose trademark application for the TITTY MONSTER mark was opposed by Monster Energy Company; pro bono representation resulted in Monster withdrawing its opposition with prejudice.
  • Songwriters and music publishers before the CRB in Phonorecord IV, adverse to Amazon, Apple, Google, Spotify, and Pandora, resulting in increased mechanical royalty rates for streaming under the compulsory license.
  • A music label and publisher against a large social media platform for large-scale infringement of its works.

Transactional Matter Highlights

  • Kat Craddock and her investment partner in their purchase of substantially all of the assets of SAVEUR, the food and travel publication, from affiliates of Recurrent.
  • Additional transactional matters for SAVEUR, including contracts and IP licensing agreements.
  • Conceiving and drafting terms of use for a complex IP and derivative rights regime in connection with NFTs and fictional worldbuilding.
