Pryor Cashman Wins Award Of Over $900,000 in Attorneys’ Fees and Costs for Client EMI Publishing in MP3Tunes Litigation
Pryor Cashman has obtained a judgment awarding almost $800,000 in attorneys’ fees and almost $150,000 in costs that its client, EMI Music Publishing (now administered by another Pryor Cashman client, Sony/ATV Music Publishing), incurred responding to defendant Michael Robertson’s unreasonable conduct in a litigation where Robertson and MP3tunes were found liable for willful copyright infringement of EMI’s works last year.
Judge William H. Pauley III of the U.S. District Court for the Southern District of New York, who has presided over the case since 2007, found in his 12-page opinion that the time Pryor Cashman submitted for recovery “was reasonably incurred” responding to Robertson's misconduct, and that Pryor Cashman’s rates were “within the ranges of rates typically approved by courts in this District.”
