Partner Joshua Zuckerberg Speaks to SHRM about Family and Medical Leave Act
Partner Joshua Zuckerberg was recently interviewed by SHRM, the Society for Human Resource Management, in connection with its March 15, 2010 article, "Employers, Attorneys Ready for Battle Over Military Leave, FMLA Regs."
The article discusses the rules expected to be issued by the U.S. Department of Labor qualifying exigency, military caregiver leave and other Family and Medical Leave Act (FMLA) controversies.
Zuckerberg, a member of Pryor Cashman’s Labor Group, told SHRM that employers should be especially interested in further clarifying the interaction and potential overlap of FMLA leave for qualifying exigencies and for military caregiver leave. "An employee with his or her own serious health condition could get 12 weeks leave for that and come back soon after for up to 26 weeks of military caregiver leave for a serviceman. That’s one I think employers would appreciate having as much clarity as possible on."
