Partner Judith Poller Speaks to Forbes.com About Divorcing Couples' Rights to the Marital Home
Partner Judith Poller, Co-Chair of Pryor Cashman’s Family Law Group, was interviewed by Forbes.com for its June 11, 2013 article, "Should you move out of the marital home? Learn from divorce attorneys, not the tabloids."
Using the example of celebrity couple Bethenny Frankel and Jason Hoppy, who have both chosen to remain in their home while pursuing a divorce, the article examines divorcing couple’s options concerning marital assets, particularly the residential dwelling place during the divorce process.
According to Poller, "The apartment remains a marital asset subject to distribution regardless of who lives there." She added that "before no-fault divorce was enacted, leaving a residence could result in a ground for 'abandonment' being able to be asserted. But that law changed in 2010."
