Pryor Cashman Defeats Motion to Quash Subpoena Requiring NYC to Produce 911 Call Taking System Report to UFOA

Pryor Cashman has been representing the Uniformed Fire Officers Association (“UFOA”) in a lengthy litigation before the New York City Office of Collective Bargaining regarding whether the City’s 911 call taking system has a safety impact on New York City fire officers and fire fighters. During that proceeding, Pryor Cashman, on behalf of the UFOA, has sought a number of documents, including a consulting report commissioned by the City which allegedly is very critical of the 911 call taking system (the “911 Report”).

On February 29, 2012, Justice Arthur F. Engoron of the N.Y. Supreme Court (N.Y. County) issued a judicial subpoena requiring the City to produce the 911 Report. The City subsequently moved to quash that part of the subpoena which required production of the 911 Report.

On April 9, 2012, Pryor Cashman Labor and Employment Partner Joshua Zuckerberg and co-counsel Paul Linzer (who represents the Uniformed Firefighters Association) successfully argued the motion before Justice Engoron and defeated the motion to quash. The Court ordered the City to produce the 911 Report by April 16, 2012.
