Kamaraju Comments on Mental Health Evidence in Trials

Pryor Cashman Partner Sidhardha “Sid” Kamaraju, a member of the White Collar Defense + Investigations, Financial Institutions, and Litigation Groups, spoke with Law360 about the use of mental health evidence in determining competency in trials.

In “Girardi’s Mental State Emerges As Early Legal Battleground,” Sid comments in the context of the trial of Tom Girardi, founder of the Girardi Keese law firm whose Alzheimer’s diagnosis is being weighed against his potential culpability in charges of theft from clients.

Sid says of evidence being presented at trial regarding Girardi’s mental state, “The most powerful evidence is always going to be evidence from treating physicians at the time,” adding, “In a lot of these cases, the defendant may be undiagnosed at the time [of the misconduct], and trying to retroactively prove that can be difficult.”
