Partner Dyan Finguerra-DuCharme Speaks to Law360 About Government Shutdown Placing Patent Cases on Hold

Partner Dyan Finguerra-DuCharme, a member of Pryor Cashman’s Intellectual Property Group, spoke to Law360 for its article “Shutdown Puts ITC Patent Cases Into Deep Freeze.” The article reports that patent cases at the U.S. International Trade Commission may face significant disruptions as a result of the government shutdown that began Tuesday, October 1, 2013.

The ITC is expected to entirely halt its investigative activities due to the shutdown, placing all pending patent cases at the commission into a holding pattern until further notice. Additionally, the Copyright Office may also close during the shutdown.

According to Finguerra-DuCharme, whose practice focuses on intellectual property litigation and copyright disputes, “[e]ven if it doesn’t immediately cause major disruptions for practitioners, the shutdown of the Copyright Office could have lingering effects on its business…since the office is already ‘understaffed and overwhelmed.’” She told Law360, “I’m afraid that if they get a backlog of applications filed during the shutdown, there are going to be delays.”
