Morell Speaks to Law360 About Newly-Revamped Form I-9
On November 14, 2016, U.S. Citizenship and Immigration Services (“USCIS”) issued a new version of the Form I-9 containing various improvements aimed at helping employers and workers provide information more easily and efficiently.
Form I-9, which must be submitted for every worker on an employer’s payroll, is used to confirm an employee’s identity and work authorization.
Beginning on January 22, 2017, all employers in the U.S. will be required to use the updated version of the Form, which features added enhancements like drop-down menus, calendars for filling in dates, on-screen instructions, informational prompts and space for providing extra information.
While the Form and others like it may seem like standard operating procedure for any business, employers who submit forms with improper information or mistakes can face significant fines. In one recent case, the U.S. Department of Justice ordered an employer to pay nearly $210,000 in fines, following its failure to properly file work authorization forms.
Still, Pryor Cashman Immigration Partner Avram Morell believes the new Form will ultimately help employers provide more accurate information to USCIS, once they “figure it out,” telling Law360, “there’s always a learning curve involved, and that will make it difficult.”
