Rose Comments on Manufacturer Payment Disputes in Saks Global Case

Pryor Cashman Partner Brad D. Rose, Co-Chair of the Intellectual Property Group, was quoted by Women’s Wear Daily (WWD) following the legal dispute between Jovani Fashion and Saks Global over unpaid bills. While not directly involved in the case, Brad shared valuable insights into the broader challenges manufacturers face in such situations.

In the article “Jovani Sues Saks Global Over $295K in Unpaid Bills,” Brad commented:

"It really is a very difficult decision for a manufacturer to make to sue a major retailer. There's a lot of stress on both sides. The environment is just getting tighter for manufacturers as they become further squeezed by rising costs and inflation."

He also emphasized the claims manufacturers can have in such cases, stating,

"In New York and in many other states, if you send an invoice and it’s held by the recipients for a reasonable period of time and there’s no objection to it, there’s a presumption that’s created that the money is owed and you have no defense[.]”

Brad's perspective highlights the tough decisions manufacturers must make when dealing with large retailers, as well as the increasingly strained business environment that makes these disputes even more challenging.
