Daniel Derby is a member of Pryor Cashman’s Litigation Group, where he represents clients in a wide variety of complex commercial matters, arbitrations, appeals, criminal cases, and government investigations.
A skillful advocate for clients at all stages of litigation, Dan represents public and private entities as well as individuals from the financial, media, real estate, nonprofit, and entertainment industries, among many others.
Dan’s experience includes:
- Dismissal of a suit brought by the sole shareholder of a food distribution business alleging fraud, tortious interference, conspiracy, breach of fiduciary duty, and related claims against a cooperative of produce merchants operating a wholesale produce market.
- Dismissal of a suit alleging fraud, breach of contract, breach of fiduciary duty, and related claims against a bank and two of its employees in connection with a loan facility letter.
- Judgment on the pleadings in a suit alleging civil RICO violations against multiple entertainment companies and related individuals, resulting in dismissal of the case, and an injunction against the pro se plaintiffs preventing them from commencing future litigation based on the same allegations.
- Defense of a nonprofit organization against international copyright infringement claims in connection with the planned public dissemination of scholarly archival materials.
- A major foreign student exchange program in connection with three proceedings challenging the government’s denial of the program’s application for real property tax exempt status.
- Individuals in response to grand jury subpoenas and in felony and misdemeanor criminal matters.
