Donald S. Zakarin

Donald Zakarin, Chairman of Pryor Cashman’s Litigation Group, was interviewed by Reuters in connection with an April 7, 2009 article about Sun Microsystems Inc. and how its shares tumbled 23% after it rejected a $7 billion buyout bid from IBM.

Zakarin, when asked about the possibility of lawsuits by Sun shareholders who were angry that Sun had rejected IBM’s bid, responded that any shareholder lawsuit may face difficulty unless it can prove that Sun's board was opposed to any deal and that it did not reasonably consider an offer. Zakarin noted that “[i]t would be hard to suggest in this case that Sun’s board was not interested in selling.”
