Pryor Cashman Partner Dyan Finguerra-DuCharme, co-chair of the Intellectual Property Group, served as a judge for the Cardozo Fashion, Arts, Media, and Entertainment (FAME) Center Intellectual Property Law Moot Court Competition.
Dyan judged Cardozo School of Law students in a moot court session for the fictional case Scarlet Broadcasting v. Plum Enterprises, which focused on three IP issues:
- Whether and to what extent Defendant’s use of Plaintiff’s trademark in an expressive work is entitled to heightened First Amendment protection.
- Whether alleging a claim for work made-for-hire under 17 U.S.C. § 101 largely, but not independently based on the Reid control factor, is sufficient to survive a motion to dismiss under Rule 12(b)(6).
- Whether a server necessarily must contain a copy of an embedded or framed copyrighted work in order to violate the 17 U.S.C. § 106(5) display right.
