Morell Authors Article About Requirements of PERM Applications

Partner Avram Morell, a member of Pryor Cashman’s Immigration Group, has authored the article, “More than Meets the Eye: Points of Focus in the Education and Experience Requirements of PERM Applications.” The article was included in the Conference Handbook for the 18th Annual AILA New York Chapter Immigration Law Symposium held on December 1, 2015.

The article addresses actual minimum requirements, on the job experience, experience at related businesses and contract employment in the PERM labor certification process. The Office of Foreign Labor Certification will review the stated job requirements on the FORM ETA-9089 and decide whether they represent the employer’s “actual minimum requirements” for the job opportunity. Therefore, when asked to assist with a PERM labor certification, practitioners must carefully gather and study the job requirements from the employer at case initiation.
