Pryor Cashman Secures Win in 'Rosemary's Baby' Case

The United States Court of Appeals for the Second Circuit has dismissed a lawsuit alleging copyright infringement in relation to the NBC production of "Rosemary's Baby." Partner Tom J. Ferber and counsel Ross M. Bagley represented NBC Television, Lionsgate Entertainment, Netflix, and other appellees. News of the dismissal was covered by Law360. According to the publication:

The three-judge panel affirmed a lower court decision tossing Wilhelmina Montgomery's lawsuit against various parties including NBC Television, Lionsgate Entertainment Corp. and Netflix. While Montgomery alleged that the "Rosemary's Baby" miniseries infringed her copyright on two stories she wrote, the panel found "the 'total concept and overall feel' of the miniseries is very different from the two short stories."

"Given the absence of any recognizable similarity between the protectable elements of the works, these arguments are unavailing," the panel said. "A review of the three works at issue in this case reveals that their plots are entirely dissimilar."
