Changes to Federal Overtime Rules Postponed

On November 22nd, a Texas federal judge issued a nationwide injunction blocking the implementation and enforcement of a new overtime rule under the Fair Labor Standards Act (“FLSA”) which had been scheduled to take effect on December 1, 2016. (See our earlier Legal Update concerning the provisions of the new rule here). This means that the new rule will not go into effect on December 1.

Instead, the injunction will postpone the implementation of the rule for an unknown period of time while the U.S. Department of Labor and the business groups and states challenging the rule continue to litigate whether it should take effect as originally planned.

We will continue to closely monitor the litigation surrounding the rule and provide updates concerning its implementation.
