In the article, Jeff, Dyan, and Andy note that because “[f]ederal registration of trademarks is unavailable to a cannabis business… [a] well thought-out, carefully executed brand development and protection plan can be a meaningful substitute for federal registration[,]” particularly for multi-state operators.
