Morell Outlines TPS Employment Authorization Process

Pryor Cashman Partner Avram Morell, a member of the Immigration Group, co-wrote an article for the American Immigration Lawyers Association (AILA) outlining what immigration lawyers need to know about the  Temporary Protected Status (TPS) program administered by the US Department of Homeland Security (DHS).

In “Practice Pointer: Demystifying Employment Authorization Under TPS,” Avi notes that the TPS program, which “provides certain noncitizens, for whom return to their home country is determined to be unsafe, permission to remain and work in the United States for a designated period,” can create “a great deal of confusion about when employment authorization begins and ends for those who have been granted TPS status, as well as how employers should properly complete and reverify Forms I-9 for these employees.”

The practice advisory article explains the TPS program, identifies specific challenges for employers, and details the three types of filing extensions available: the Federal Register Notice Extension, the Automatic Renewal EAD Extension, and the Automatic EAD Extension by Individual Notice.
