Taylor Explores Estate Administration of Global Art Collections
Pryor Cashman Associate Olivia Taylor, a member of the Art Law Group, co-authored the article “Navigating the Estate Administration of Art Collections: How to administer artwork located in different jurisdictions,” published in the March 2023 issue of Trusts & Estates.
In this piece, Olivia addresses the legal and practical complexities that arise when an artist or collector’s work is spread across state and international borders. As art collections increasingly span private residences, galleries, storage facilities, and museums around the globe, estate administration has grown more challenging for fiduciaries and executors.
The article examines how probate proceedings must often take place in multiple jurisdictions, including both the decedent’s state of domicile and any other state or country where artwork is located. It also discusses valuation issues in light of recent case law, the potential for conflicting tax obligations, and complications posed by artwork containing restricted materials or subject to cultural patrimony claims.
