Eric D. Sherman, a partner in Pryor Cashman’s Real Estate Litigation Group, was quoted in the October 18, 2011 edition of The New York Times article entitled, “True to Mailer’s Life, a Brawl Over the Sale of His Brooklyn Heights Apartment.” The article by Marc Santora discusses the dispute over the recent sale of Norman Mailer’s apartment in Brooklyn, N.Y. to hedge fund manager, Wesley Golby.

According to the publication, Mr. Golby, who was attracted to the apartment and its unusual layout, the results of a renovation performed in the early 1960s, signed an agreement to purchase, and submitted a deposit of $208,750. After putting down his deposit, Mr. Golby claims the Mailer estate failed to provide evidence to back up assurances that the renovation work was done legally and in accordance with zoning laws and building codes. He now wants to be released from his contract and have his deposit returned.

Mr. Sherman, a lawyer representing the Mailer estate, said in a statement that his client “has complied fully with the terms of the underlying contract of sale and has made no misrepresentations whatsoever.” “This is simply a case of buyer’s remorse,” he said.
