Pryor Cashman Wins Dismissal of Suit Brought Against Courtney Love By Her Landlord

Pryor Cashman successfully represented Courtney Love in her bid to dismiss a lawsuit filed by her landlord Astor Street Partners, LLC which demanded rent payments before they were due. 

In her January 17, 2012 decision in Astor Street Partners LLC v. Cherry Forever Records, Inc., Judge Jean T. Schneider of the N.Y. City Civil Court granted Love’s motion for summary judgment and dismissed the landlord’s petition, finding that the landlord had served a rent demand seeking rent “not yet due.”

“She will not be evicted,” said Eric Sherman, a partner in Pryor Cashman’s Real Estate Litigation Group. “As the Court properly determined, the lawsuit was wrongly filed in the first place because Ms. Love was current on her rent. In fact, she paid her rent on time, if not before the due date each month. We’ve always said that this was a baseless claim where the landlord was incorrectly seeking future rent. We are pleased that the Court agreed with our position and granted Ms. Love’s motion to dismiss the landlord’s case.” Sherman represented Ms. Love, with the assistance of associate Eric Dowell.
