Partner Michael Novicoff is a member of Pryor Cashman's Litigation, Media + Entertainment, Intellectual Property and International Groups.
He has extensive experience handling complex business litigation, arbitration and mediation throughout North America, Europe and Asia, with particular emphasis on matters involving entertainment, media and intellectual property, and on the liability of corporate entities and their directors and officers. He speaks and teaches frequently on these subjects around the world.
Mike has a long and proven record of client success which includes:
- Obtaining the complete dismissal of all claims for multiple officers and directors alleged to be part of a multi-million-dollar corporate fraud
- Successfully prosecuting claims against U.S. parties on behalf of foreign governments and their agencies
- Obtaining the complete dismissal of all claims alleged against an agency of a foreign government sued in United States District Court
- Obtaining the complete dismissal of “idea theft” and related claims alleged against a creator and writer of a hit television show
- Successfully defending major motion picture and television producers against multiple claims for credits and profits by alleged writers and investors
- Obtaining, confirming and collecting a large arbitration award for a foreign producer against a local sales agent
- Successfully defending a motion picture sales agency against claims by foreign distributors
- Obtaining, confirming and collecting multiple large arbitration awards for an international bank against local and international motion picture producers and distributors
- Successfully managing the defense of multiple copyright infringement actions and other intellectual property claims against U.S. parties pending in France, Russia, Romania, Taiwan and Brazil, among other jurisdictions
- Successfully enforcing U.S. arbitration awards against parties throughout the world
Mike also serves frequently as an Arbitrator and is a member of the American Arbitration Association’s Commercial Arbitration Panel, as well as the International Arbitration Tribunal of the Independent Film and Television Alliance (formerly known as “AFMA”), where he resolves complex disputes throughout the international motion picture distribution industry. He also serves as an arbitrator and mediator for the World Intellectual Property Organization (WIPO) Arbitration and Mediation Centre and for WIPO's Film and Media Centre.
Mike has served as lead counsel across the United States to a substantial number of foreign governments and prominent global corporations and has been engaged frequently to manage litigation pending in other countries, particularly within the worldwide entertainment industry.
