Noh Speaks to Law360 about Liabilities Related to Embedding Social Media Posts

Partner Megan Noh was interviewed by Law360, following Instagram's recent update to its privacy policy, which now states that "websites should not 'embed' posts without first clearing 'all necessary rights'." The change could spur significant changes to news media outlets' approach to social media platforms.

Noh notes that "Publishers have generally understood broad platform policies as allowing them to embed images and other user content without further permissions." [...] "Greater optionality for designation of individual posts seems like a no-brainer to balance the interests of rights-holders with those of users of the embedding tool."
