Zuckerberg Discusses Gentry v. Hamilton-Ryker IT Solutions
Pryor Cashman Partner Joshua Zuckerberg, co-chair of the Labor + Employment Group, spoke with Law360 about a Fifth Circuit decision in Gentry v. Hamilton-Ryker IT Solutions.
In “5th Circuit Decision Hints At Salary Debates To Come,” Josh highlights the potential ramifications of the ruling on future legal challenges:
"With a wage and hour statute like this, you have to be careful because you could really end up exposed to significant damages," he said, "and then you've got a court that seems very welcoming to challenges to rules and regulations."
He also discusses the intricacies of defining a weekly salary
“This notion of trying to capture salary basis by having some relatively minor piece of the week be considered guaranteed, is not going to cut it," he said. "I think you're going to see that it has to be more in line with that 1 to 1.5 ratio in order for it to be really considered salary basis.”
