Pryor Cashman Submits Amicus Curiae Brief to U.S. Supreme Court in Case Involving Compensation to Medical Residents
Share This Page:
Pryor Cashman LLP submitted a brief on behalf of client and amicus curiae Doctors Council SEIU, in the case of The Mayo Foundation for Medical Education and Research et. al. v. United States, Docket No. 09-837, on October 4, 2010.
The primary issue in the case is whether the compensation received by medical residents is subject to the FICA tax or, alternatively, residents are subject to the student exemption. The primary argument in Pryor Cashman’s brief is that residents are employees, not students.
The brief was authored by Labor and Employment Partner Richard M. Betheil.
