A Hotel's Liability for Cybertheft of Guest Data

Partner Todd Soloway, head of Pryor Cashman’s Real Estate Litigation Practice, co-authored the New York Law Journal article “Protection of Hotel Guest Data and Personal Information.”

Hotel owners and manager have a duty to provide adequate data security measures to protect the information of their guests from cyber criminals. The statutory duty derives from the Federal Trade Commission Act (FTC Act) which prohibits “unfair” acts or practices in commerce. The article discusses the standard of liability a hotel manager/owner might be held to in the event of a data breach.
