Caton Comments on Increasing State Regulation Surrounding Bias in Workplace AI Tools

LaKeisha M.A. Caton, a partner in the firm’s Labor + Employment and Litigation Groups and co-chair of the Discrimination + Harassment and Restrictive Covenants + Trade Secrets Practices, spoke with Law360 to discuss a new Illinois AI law focused on protecting job candidates and employees evaluated by artificial intelligence. The law follows an increase in the number of states that have imposed rules limiting employers’ use of AI that may lead to bias.

In “Illinois AI Bias Law Shows States Zeroing In On Workplaces,” LaKeisha comments on how notice mandates are expected to become increasingly popular:

"I do think that this is going to be common, this notice requirement. At a minimum, it's trying to give employees the opportunity to be aware of the use of AI."
