Pryor Cashman Defeats Motion to Enjoin “The People's Court”
Pryor Cashman defeated a motion by a disappointed litigant from the popular television show, "The People’s Court", to enjoin an upcoming broadcast of the program.
The plaintiff, Claudia Evart, claimed that the arbitrator on the show, Judge Marilyn Milian, who has adjudicated disputes for "The People’s Court" since 2001, “offended” Evart in the course of Judge Milian’s ruling against her. Evart sought to enjoin the broadcast of the episode which, she claimed, “distorted the judicial process.” Pryor Cashman opposed the application on behalf of the producers.
Judge Lucy Billings of the New York State Supreme Court agreed with Pryor Cashman’s arguments, which were rooted in First Amendment law and also based on agreements that Evart had signed in connection with her appearance on the program.
The case, Claudia Evart v. Ralph Edwards/Stu Billett Productions, received widespread press coverage.
Representing the producers in the litigation were Pryor Cashman Litigation Group Partners Tom Ferber and William Charron, and associate Bryan Mohler.
